These terms and conditions apply to all orders placed by the customer with Naudic, at Naudic.com

By placing an order, you enter into an agreement with us and accept these Terms and Conditions. We may modify the Terms and Conditions from time to time. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

We recommend that you download our Terms and Conditions to keep a copy for your reference.

 

                               RETURN POLICY

We always aim to delight our customers with our products and service and hope that you adore your new pieces! Please review and carefully consider all of the following conditions prior to placing your online order. If you are not completely satisfied with your online purchase, we welcome you to complete the return request form below for any eligible product within 28 days of purchase.

FULL PRICE ITEMS

Items that have been purchased at full price from our online boutique or Salisbury showroom are eligible for a refund or store credit when returned to Naudic within 28 days of purchase. Return shipping is at cost of purchaser. Please return products in their original condition with tags. For a return to be processed, items must be unworn, unwashed and free from deodorant / perfume / makeup or other odours.

SALE ITEMS

Products which have been reduced in price due to special or promotion cannot be refunded (unless found to be faulty and are unable to be replaced due to stock availability). Sale products are eligible for a gift card only.

OUTLET & SAMPLES 

Outlet items and sample products are clearly marked on our website and are a final sale. We will not accept returns for outlet or sample products. Please choose carefully as they are unable to be returned or exchanged.

JEWELLERY

Due to hygiene reasons, all purchases of jewellery are a final sale. We will not accept returns for jewellery.

EXCHANGES

We do not offer exchanges due to the limited nature of our unique products. If you would like a different size or style, we recommend purchasing the new item and following the return process for your original order.

FAULTY ITEMS

In the event you receive a faulty garment, we are very sorry! Please email our team at shop@naudic.com and include an image of the issue so that we can resolve things for you as soon as possible. We will meet our obligations under the Australian Consumer Law which may include replacing the item should the stock be available or providing a refund upon receipt of the item back to our warehouse.

AUSTRALIAN RETURNS PROCESS 

All domestic customers must submit a return request form through the returns portal on our website. Once we receive your return request, you will receive a confirmation email including our postal address so that you can post your return to us. Return shipping is at the cost of purchaser. We encourage our customers to reuse their original packaging to ship their return. Our team will be in touch via email if they have any questions regarding your return request.

INTERNATIONAL RETURNS PROCESS 

All international customers must email shop@naudic.com to organise a return with our team. Our international customers are responsible for their own shipping cost to return unwanted items (tracking encouraged). A gift card will be issued for eligible products only. No refunds will be processed for international returns.

ADDITIONAL INFORMATION

Unapproved returns will not be processed. Please do not send items back without return approval through our returns portal. "Free gift with purchase" items must be included with your return or the cost of the item will be withheld from your return. We are unable to offer price adjustments for promotions and discounts. Promotions and discounts cannot be applied retrospectively to orders placed before a promotion commenced or after it has concluded. Items must be returned in their original condition, unworn, unaltered, unwashed and with tags attached.

APPLICABLE LAW

These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by Australian law. NAUDIC may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.

OWNERSHIP OF RIGHTS

All rights, including copyrights at Naudic.com remain with NAUDIC and its subsidiaries. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.

PRICING POLICY AND CHARGES

All prices displayed in the NAUDIC online store include Goods and Services Tax (G.S.T) and exclude shipping fees. The shipping fees will be added to the order in the checkout step.

PRIVACY POLICY

The personal information you forward to NAUDIC will only be used in order to fulfill the undertakings NAUDIC have and to assure you the best service. NAUDIC will not let a third party see or use your personal details without your prior consent. You have the right to see your personal details upon request. NAUDIC assumes responsibility for all personal information that you make available to us and does not pass on any information to a third party under any circumstances. If the information is incomplete or incorrect, you have the right to have the information corrected or deleted. NAUDIC COPYRIGHT

Naudic designs are protected under Australian copyright law. No part of these designs may be reproduced or transmitted by any means, electronic or mechanical, without the written permission of the Naudic Designer, except where permitted by law. You may not use the materials or designs for commercial purposes.

Naudic designs is copyrighted according to the terms of the Creative Commons non commercial license (http://creativecommons.org/licenses/by-nc/2.5/).
It may not be reproduced, in its part or its entirety, for any use whatsoever. No part of these clothing styles, designs, textiles may be reproduced for sale by any party.

You agree not to:

• copy, distribute, display, and or reproduce any of these designs.
• make derivative works.
• you may not use these designs for commercial purposes.
• any of these conditions can be waived if you get permission from the copyright holder.

TERMS OF USE

You agree that you shall indemnify and defend Naudic and all parties from whom Naudic has licensed portions of designs, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Design.

Trade secrets and other types of “undisclosed information” which have commercial value must be protected against breach of confidence and other acts contrary to honest commercial practices. But reasonable steps must have been taken to keep the information secret.

COPYRIGHT MATERIALS

Naudic designs contains graphics, photographs, images, artwork, text, fonts, and other information (referred to herein as“designs”). These designs and all Content are the copyrighted property of Naudic, and/or its subsidiaries (referred to herein as “Naudic”) or the copyrighted property of parties from whom Naudic has licensed such property. All rights of these designs and its Content are reserved worldwide. It is strictly prohibited to retain, copy, distribute, publish, or use any portion of the designs except as expressly allowed in these Terms of Use. Naudic reserves the right to add to, delete from, or modify any part of Designs at any time without prior notice. Any modifications to designs, whether by You or Naudic remain the property of Naudic and its licensors.
The logo design provided on the designs employ a limited number of elements, including icons, fonts, colour schemes, and design effects. Naudic reserves the right to use all such elements and to make all such elements available for use by other parties in the future. You do not obtain any right or claim to any of the individual design elements through your creation of a design and/or your incorporation of a design into one or more products.
Naudic provides no warranty of any kind that designs created will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the design is legally available for your use and does not infringe the rights of another party.
